Terms of Service

These Terms of Service govern use of the website at ramka.dev and the purchase of paid ramka licenses.

The website is operated by Artur Bień, operating under the business name Expensive Toys (“we”).

By using the website or purchasing a paid license, you agree to these Terms.

The software itself is licensed separately. ramka is publicly available through the npm registry and may be used under GPL-3.0-only, subject to the GPL's terms. A paid proprietary license is granted only under the Ramka License Agreement. These Terms do not grant any software license.

The website

ramka.dev provides documentation, examples, licensing information, and a way to purchase a paid license.

The site is offered as-is. Features, content, and availability may change. We do not promise uninterrupted access.

The software

@ramka/react is a headless user-interface library for React, distributed through the public npm registry. It requires React and ReactDOM version 18 or later, supplied by your application, and a standard JavaScript build toolchain. It contains no license keys, activation, or other technical protection measures. Documentation is at ramka.dev/docs.

ramka is publicly available under GPL-3.0-only before any purchase. A paid license does not unlock a private package or deliver separate software files. What you purchase is an alternative proprietary license grant: the right to use ramka in proprietary products without relying on the GPL, within the scope of the purchased license tier (Indie, Business, Agency, or Embedded / OEM).

Purchases are subject to the Ramka License Agreement in effect at the time of the order, together with the order itself; the License Agreement forms part of the purchase. The license tier, price, and Licensee identity are those recorded on that order.

Refunds, statutory withdrawal rights, and what happens to the paid license after a refund or withdrawal are described in the Return Policy and the License Agreement.

Consumers

A consumer is an individual entering into a contract primarily for purposes outside their trade, business, craft, or profession. An individual purchasing for professional purposes (for example, a freelancer buying ramka for client work) is not acting as a consumer merely by being an individual.

If you are a consumer, you retain all rights granted to you by mandatory consumer law. In particular:

  • You may have a statutory right of withdrawal from a distance purchase; see the Return Policy. We honor mandatory withdrawal rights where they apply.
  • You have statutory rights regarding the conformity of digital content with the contract, and complaint rights, under applicable law; see the Return Policy and the License Agreement.
  • Nothing in these Terms or the Ramka License Agreement excludes, restricts, or limits rights or remedies that cannot lawfully be excluded or limited, including mandatory statutory rights available to consumers.

Under Polish law, certain consumer protections also apply to an individual entrepreneur entering into a contract directly related to their business activity when the contract is not of a professional character for them.

Payments

Payments for paid licenses are processed through Whop. By completing checkout, you also agree to the payment terms Whop presents at checkout.

We receive the order information needed to grant and administer the license. Payment card details are handled by Whop, not stored by us. Refunds we approve or owe are processed through Whop back to the original payment method.

Pricing and taxes

Prices are those shown at the time of purchase. We may change published prices at any time; a change does not affect an order already completed.

Taxes, duties, or similar charges may apply and may be added or collected at checkout by Whop; the checkout shows the total before you confirm the order. You are responsible for any amounts that remain your obligation under applicable law.

Buyer information

You must provide accurate contact and Licensee details at checkout or when you enquire: typically name, company or legal-entity name where applicable, and billing email.

The license is granted to the individual or legal entity identified on the order. See the Ramka License Agreement for transfer rules.

Support is provided by email when we are able to respond. We do not offer guaranteed response times, telephone support, or a service-level agreement. This does not limit our obligation to respond to consumer complaints as required by applicable law.

Acceptable use

You may not use the website to:

  • attempt to gain unauthorized access, disrupt, or overload the site
  • probe, scan, or reverse-engineer the site except as permitted by law
  • submit false, misleading, or another person's information in an order or enquiry
  • circumvent checkout, payment, or license checks
  • impersonate us or misuse ramka branding
  • use the site for any unlawful purpose

Intellectual property

The website, its documentation presentation, and ramka names, logos, and other branding are owned by Artur Bień or used with permission. You may not copy, frame, or republish the site, or use the branding, except as needed to use the site itself or as allowed by the applicable software license.

@ramka/react remains subject to GPL-3.0-only or the Ramka License Agreement, as applicable. Third-party notices are at ramka.dev/license/notices.

Disclaimers and liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS”, WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM USE OF THE WEBSITE OR FROM A PURCHASE MADE THROUGH IT.

FOR A PAID LICENSE PURCHASE, OUR TOTAL LIABILITY IS AS STATED IN THE RAMKA LICENSE AGREEMENT. FOR USE OF THE WEBSITE ALONE, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE TRANSACTION GIVING RISE TO THE CLAIM, OR ZERO IF YOU PAID NOTHING.

Nothing in these Terms or the applicable License Agreement excludes, restricts, or limits rights or remedies that cannot lawfully be excluded or limited, including mandatory statutory rights available to consumers, such as statutory rights regarding the conformity of digital content with the contract.

Warranty and liability terms for the software itself are in the applicable software license, not in these Terms.

Suspension

We may suspend or block access to the website if we reasonably believe these Terms have been violated, or if needed to protect the site, other users, or our rights. Suspension of the website does not, by itself, terminate a paid license already granted. License termination is governed by the Ramka License Agreement.

Governing law

These Terms are governed by the laws of Poland, without regard to its conflict of laws rules. If you are a consumer, this choice of law does not deprive you of the protection of provisions that cannot be derogated from by agreement under the law of the country of your habitual residence.

For users who are not consumers, any dispute arising out of or relating to these Terms or the website will be subject to the exclusive jurisdiction of the courts competent for our registered place of business in Poland or, if we have no registered place of business, our place of residence, unless applicable law requires otherwise. If you are a consumer, jurisdiction is determined by applicable law.

Changes

If we update these Terms, we will publish the revised text at ramka.dev/terms. Continued use of the website after a change constitutes acceptance of the updated Terms. Changes do not retroactively alter a paid license already purchased unless you agree to those changes.
